Te los contamos a continuaci\u00f3n.<\/span><\/p>\n<p><a href=\"http:\/\/tugesto.com\/software-lopd\" target=\"_blank\" rel=\"noopener\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-7899 size-full\" src=\"https:\/\/tugesto.com\/blog\/wp-content\/uploads\/2018\/01\/LOPD.gif\" alt=\"Servicio de protecci\u00f3n de datos\" width=\"1000\" height=\"600\" \/><\/a><\/p>\n<h2><span style=\"color: #4c4f54;\">Protecci\u00f3n de datos y Curr\u00edculum Vitae: \u00bfQu\u00e9 hacer si recibes un CV?<\/span><\/h2>\n<p><span style=\"color: #4c4f54;\">Si optas por guardar los curr\u00edculums recibidos, deber\u00e1s cumplir con todas las exigencias establecidas en la RGPD tales como la <strong>creaci\u00f3n e inscripci\u00f3n del fichero en el <\/strong><\/span><span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/tugesto.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">tugesto<\/a><\/span><strong>, <span style=\"color: #4c4f54;\">garantizar los derechos de acceso, rectificaci\u00f3n, cancelaci\u00f3n u oposici\u00f3n, cumplimiento del deber de informaci\u00f3n, del deber de secreto, adopci\u00f3n de las medidas de seguridad que correspondan<\/span><\/strong><span style=\"color: #4c4f54;\">, etc.<\/span><\/p>\n<p><span style=\"color: #4c4f54;\">La RGPD modifica algunas condiciones y obligaciones con respecto a la antigua LOPD en referencia a la conservaci\u00f3n de datos y la informaci\u00f3n que se proporciona al usuario.<\/span><\/p>\n<p><span style=\"color: #4c4f54;\">Algunos de estos son:<\/span><\/p>\n<h3><span style=\"color: #4c4f54;\">La existencia de un fichero o tratamiento de datos<\/span><\/h3>\n<p><span style=\"color: #4c4f54;\">As\u00ed como la finalidad de la recogida de los datos y los destinatarios de la informaci\u00f3n.<\/span><\/p>\n<h3><span style=\"color: #4c4f54;\">El car\u00e1cter obligatorio de informar de una manera concisa y clara<\/span><\/h3>\n<p><span style=\"color: #4c4f54;\">Por ejemplo, se\u00f1alando los campos obligatorios con un asterisco (*), informar exactamente el <strong>tratamiento que van a recibir sus datos<\/strong>: qu\u00e9 va a hacer la empresa con sus datos, d\u00f3nde van a estar almacenados, etc.<\/span><\/p>\n<h3><span style=\"color: #4c4f54;\">Almacenamiento de datos<\/span><\/h3>\n<p><span style=\"color: #4c4f54;\">Cualquier <strong>curr\u00edculum<\/strong> que lleve <strong>almacenado<\/strong> en la base de datos de la sociedad <strong>un tiempo superior a 24 meses debe ser bloqueado<\/strong> para evitar el acceso a datos personales, seg\u00fan dicta el art\u00edculo 5 del Reglamento General de Protecci\u00f3n de Datos.<\/span><\/p>\n<h3><span style=\"color: #4c4f54;\">Ampliaci\u00f3n del ejercicio de los derechos ARCO<\/span><\/h3>\n<p><span style=\"color: #4c4f54;\">A los tradicionales derecho al acceso, rectificaci\u00f3n, cancelaci\u00f3n y oposici\u00f3n se le suman el <strong>derecho\u00a0de portabilidad<\/strong> y <strong>derecho al olvido.<\/strong> Por ello, deber\u00e1s poner a disposici\u00f3n del usuario alg\u00fan medio sencillo y gratuito para ejercer estos derechos, por ejemplo, tel\u00e9fono, correo electr\u00f3nico, direcci\u00f3n postal&#8230;<\/span><\/p>\n<h4><span style=\"color: #4c4f54;\">Derecho de portabilidad de sus datos<\/span><\/h4>\n<p><span style=\"color: #4c4f54;\">Una de las novedades que incluye el reglamento europeo es la posibilidad de que el candidato pida una copia exacta de los datos que le facilit\u00f3 a la empresa. La empresa est\u00e1 obligada a hacer entrega de la informaci\u00f3n en el formato original.<\/span><\/p>\n<h4><span style=\"color: #4c4f54;\">Derecho al olvido<\/span><\/h4>\n<p><span style=\"color: #4c4f54;\">Reconoce a la persona que facilita sus datos el derecho a supresi\u00f3n de sus datos personales, pudiendo solicitar que se suprima informaci\u00f3n de internet que da\u00f1e a su intimidad, a su derecho al honor o a la propia imagen.<\/span><\/p>\n<h3><span style=\"color: #4c4f54;\">La identidad y direcci\u00f3n del responsable del tratamiento<\/span><\/h3>\n<p style=\"text-align: left;\"><span style=\"color: #4c4f54;\">Ahora bien, este deber de informaci\u00f3n se puede garantizar de diferentes formas dependiendo el modo de recepci\u00f3n de los curr\u00edculums:<\/span><\/p>\n<ul style=\"text-align: left;\">\n<li><span style=\"color: #4c4f54;\">Si el curr\u00edculum se recibe por <strong>correo postal o electr\u00f3nico<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #4c4f54;\">Y se le aporta una direcci\u00f3n electr\u00f3nica podr\u00e1 remitirle la informaci\u00f3n a esa direcci\u00f3n solicitando acuse de recibo y condicionando su tratamiento al acuse de recibo.\u00a0<\/span><\/p>\n<ul style=\"text-align: left;\">\n<li><span style=\"color: #4c4f54;\">Si el curr\u00edculum <strong>se<\/strong> <strong>entrega personalmente<\/strong> en las instalaciones de la empresa<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #4c4f54;\">Deber\u00e1s informarle, en el acto, mediante cualquier medio que acredite y permita probar el cumplimiento del deber de informaci\u00f3n como carteles o documentos de acuse de recibo. Es importante que tengas en cuenta que si recibes curr\u00edculums en formato f\u00edsico, los tendr\u00e1s que<strong> trasladar a las bases de datos<\/strong> para proceder a su correcto tratamiento.<\/span><\/p>\n<p><a href=\"https:\/\/tugesto.com\/software-lopd\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignnone wp-image-20889 size-full\" src=\"https:\/\/tugesto.com\/blog\/wp-content\/uploads\/2021\/09\/incorpora-un-delegado-proteccion-datos-informate.png\" alt=\"contrata-dpo\" width=\"800\" height=\"241\" https:\/\/tugesto.com\/blog\/wp-content\/uploads\/2021\/09\/incorpora-un-delegado-proteccion-datos-informate-768x231.png 768w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/a><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">M\u00e1s peculiaridades sobre la Protecci\u00f3n de datos y Curr\u00edculum Vitae<\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">No obstante, si el curr\u00edculum se presenta por el candidato sin hab\u00e9rselo solicitado <strong>deben informarle y obtener un acuse o confirmaci\u00f3n de conocer las condiciones en las que se desarrollar\u00e1 el tratamiento<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">En caso de <strong>grupos de empresa<\/strong> o de cualquier otra f\u00f3rmula de colaboraci\u00f3n empresarial, deber\u00e1s informar al interesado de la cesi\u00f3n de sus datos y, adem\u00e1s, obtener su consentimiento.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">Si optas por <strong>deshacerte de los curr\u00edculums recibidos<\/strong>, al no guardar los datos no se crea un fichero y si no hay un fichero de datos personales no es de aplicaci\u00f3n la Ley de Protecci\u00f3n de Datos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">En caso de que recibas el curr\u00edculum mediante email, deber\u00e1s <strong>borrar ese email del buz\u00f3n y del servidor<\/strong>.<\/span><\/p>\n<blockquote>\n<p><span style=\"color: #4c4f54;\"><em>Por tanto, debes tener en cuenta que desde el momento en que guardas un curr\u00edculum se aplicar\u00e1 la RPGD y, por ende, estar\u00e1s sujeto a su r\u00e9gimen sancionador en el que se estipulan las infracciones y sus sanciones.<\/em><\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #4c4f54;\">Para evitar estas cuantiosas <strong>multas<\/strong>, te recomendamos que dispongas de un <strong>modelo de impreso para formalizar la entrega del curr\u00edculum as\u00ed como de un protocolo de formalizaci\u00f3n y entrega de los impresos por los interesados<\/strong>, pues as\u00ed podr\u00e1 informar adecuadamente y definir con precisi\u00f3n el tipo de datos a tratar, establecer las medidas de seguridad, etc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color:
