A lo largo de nuestra etapa laboral, es posible que haya d\u00edas en los que, por accidente o enfermedad, tengamos que coger d\u00edas o <strong>meses de baja<\/strong>. Y lo que es m\u00e1s frecuenta de lo que pensamos: una baja laboral por reca\u00edda.<\/p><p>Es una situaci\u00f3n bastante com\u00fan y al pasar unos cuantos d\u00edas, recibe el alta m\u00e9dica. La situaci\u00f3n m\u00e1s inusual ocurre cuando al pasar un tiempo, tiene que volver a solicitar la incapacidad temporal porque no se ha curado por completo y se resiente de la dolencia. <strong>Es en este momento cuando se habla de la baja laboral por reca\u00edda<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section se considera baja laboral por reca\u00edda?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8269333 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8269333\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Lo primero que debemos tener en cuenta es conocer en qu\u00e9 consiste la baja laboral por reca\u00edda.<\/p><p>Para definirla, recurrimos a lo que se establece en el art\u00edculo 169.2 de la Ley General de la Seguridad Social, donde se recoge: \u201c<strong><em>Se considera que existe reca\u00edda en un mismo proceso <\/em><\/strong><strong><em>de incapacidad cuando se produzca<\/em><\/strong><strong><em> una <\/em><\/strong><strong><em>nueva baja m\u00e9dica<\/em><\/strong><strong><em> por la misma o similar patolog\u00eda dentro de los ciento ochenta d\u00edas naturales siguientes a la fecha de efectos de la alta m\u00e9dica anterior<\/em><\/strong><strong>\u201d.<\/strong><\/p><p>Otro aspecto a tener en cuenta es que si la nueva baja por incapacidad temporal sucede cuando han transcurrido m\u00e1s de 6 meses desde el alta m\u00e9dica inicial, pero la causa es la misma enfermedad o tiene que ver con el mismo accidente, <b>no se considera que existe reca\u00edda<\/b>. En este caso, tendr\u00e1 que pasar por el proceso de un nuevo reconocimiento m\u00e9dico.<\/p><p>En caso de que se trate de una enfermedad com\u00fan, deber\u00e1 acreditar que, durante los 5 a\u00f1os anteriores, ha cotizado un m\u00ednimo de 6 meses. \u00danicamente de esta forma, tendr\u00e1 la posibilidad de cobrar la<strong> prestaci\u00f3n por incapacidad temporal<\/strong>. Ser\u00e1 aplicado lo mismo en los casos en los que, si dentro del plazo de los 180 d\u00edas, el trabajador vuelve a estar de baja por una dolencia que no sea la misma.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-61710a7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"61710a7\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-60d5c14\" data-id=\"60d5c14\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d3516da elementor-widget elementor-widget-heading\" data-id=\"d3516da\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfLos empleados tienen derecho a cobrar durante las nuevas bajas?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5b63972 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5b63972\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-0392b28\" data-id=\"0392b28\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-fd4e1b9 elementor-widget elementor-widget-text-editor\" data-id=\"fd4e1b9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En lo relativo a las prestaciones, la cuant\u00eda y el derecho o no a continuar cobrando, depende de cu\u00e1nto dure la baja. Las enfermedades que se conciben como comunes y accidentes que no sean laborales, hay que tener en cuenta que durante los 3 primeros d\u00edas no se cobrar\u00e1 nada. De este modo, entre el d\u00eda 4 y el 21, el empleado percibir\u00e1 el 60% de la base reguladora, pero posteriormente, la cuant\u00eda ascender\u00e1 hasta el 75%.<\/p><p>Debido a que la reca\u00edda se contempla como una continuaci\u00f3n de la incapacidad temporal anterior, se a\u00f1aden los d\u00edas en los que el trabajador estaba de baja. A pesar de ello, hay que destacar que la base reguladora tomada como referencia es la que corresponde al mes previo, por lo que las cantidades es posible que puedan diferir respecto a la primera baja.
